Abstract:
Normative aspects in the preservation of cultural heritage imply a complex understanding and approach, insofar as this is a systemic process in which different cultural institutions acting with relevant competence and the normative framework have a role. It consists of international legal acts, such as the UNESCO Conventions, EU law - the regulations and directives and the internal law that is in accordance with them.
The report covers a review of case studies related to the preservation of tangible cultural heritage: cases of dissonant cultural heritage; the case with the restitution of cultural values; cases of deregistration of tangible cultural values from the register and the philosophy of the law; legal issues in dealing with cultural property; problems of ownership of movable cultural property; the relationship of copyright and related rights to cultural heritage.

Нормативните аспекти в опазването на културното наследство предполагат комплексно разбиране и подход, доколкото това е системен процес, в който участват различни културни институции, действащи със съответната компетентност и нормативната рамка. Състои се от международни правни актове, като например конвенциите на ЮНЕСКО, правото на ЕС - регламентите и директивите и вътрешното право, което е в съответствие с тях.
Докладът обхваща преглед на казуси, свързани с опазването на материалното културно наследство: случаи на дисонантно културно наследство; казусът с реституцията на културни ценности; случаи на отписване на материални културни ценности от регистъра и философията на правото; правни въпроси при работа с културни ценности; проблеми на собствеността върху движими културни ценности; отношението на авторското право и сродните му права към културното наследство.
